Planning for the future is very important. It can be difficult thinking about a time when you may need help making decisions about your finances or your medical care.
You or a relative may be in good health now but unfortunately no one can predict with certainty what lies ahead. For instance you could lose mental capacity through an illness such as dementia or have an accident or suffer physical disability to do everyday things that prevent you managing your own affairs.
A lasting power of attorney (LPA) is a legal document that lets you appoint one or more people to help you make decisions or to make decisions on your behalf should the need arise.
There are two types of lasting powers of attorney:

Property and financial affairs LPA
- For example managing bank accounts
- Paying bills
- Selling or renting your home
- Dealing with a pension
- State benefits

Health and welfare LPA
- For example medical care
- Moving into a residential care home
- Daily routine such as food, washing, hygiene and dressing
- Life sustaining treatment
You can choose to make one type of LPA or both.
An LPA should be prepared whilst a person is still capable of making their own decisions and has mental capacity. This is indicated by their ability to provide clear instructions as to whom they would like to appoint and that they demonstrate they understand the consequences of making the document.
An early diagnosis of dementia or other illness may not necessarily prevent someone from making a lasting power of attorney and we can advise and assist you with the process. Nevertheless in such circumstances you should seek legal advice as soon as possible.
