It’s quite common to meet new clients where they have separated or even divorced but have not got round to sorting out their matrimonial finances.
It takes time to work out what you want to do and separation is highly charged and difficult for everyone. For many people there just isn’t the right time to have those discussions, for whatever reason.
It is advisable and of course sensible to eventually have a court order in place that ties all the matrimonial finances up with no loose ends. But where do you begin?
Many clients in this situation find it helpful to work with a family mediator, someone who is impartial, non-judgemental and can listen to what each of you want. You can talk through the current arrangement and the future options on the matrimonial finances in a space that works better in this instance for couples than correspondence between solicitors.
Where each party’s solicitor plays a valuable part though is in giving you each independent legal advice outside the mediation sessions both before and during the mediation process so that you are both fully aware of your position and what would happen if your matter were to be decided in the Family Court.
The solicitor is also there to put the proposal you reach in mediation into a consent order, which is then sent to the court for approval and sealing. Once it is returned approved and sealed it is then enforceable.
